Likewise, we reject appellants’ challenges to the administrative process in this case. The BIA’s consideration of evidence does not render the proceedings unlawful or unfair. Nguyen v. INS, 991 F.2d 621, 626 (10th Cir.1993). The use of the summary procedure to consider alien status and deportability is designed to allow the Department of Justice to focus its limited resources on the deportation of those aliens who are most likely to be a public menace. See 8 C.F.R. § 243.3 (1993); Nguyen, 991 F.2d at 626; see also Ettienne v. INS, 759 F.2d 196, 198-99 (5th Cir.1985) (holding that the INS satisfied its burden of proof in a summary hearing where INS merely proved alien’s deportability and alien failed to present any evidence). Although the summary procedure has been criticized because it does not allow the alien to present relevant evidence and testimony, it is still the only means available to the Attorney General and the BIA to carry out their duties of screening the aliens to identify those individuals who should be deported. Nguyen, 991 F.2d at 626.

Furthermore, the BIA is not required to conduct an evidentiary hearing to resolve contested factual issues, and we agree that it does not abuse its discretion in finding that the hearing provisions of § 242(b) are not applicable to the consideration of an application for suspension of deportation. Id. at 626; see also Kokkinis, 971 F.2d at 1119-21.

Finally, we do not find that the BIA’s denial of petitioners’ motions to reopen was an abuse of discretion. The motion was neither timely filed nor supported by new evidence. The BIA did not abuse its discretion in determining that the motions were submitted solely to obtain further review by the BIA on the suspension of deportation issue.
